Invite-only and free while we build. Point our agents only at software you are authorized to test; everything they find belongs to you, and we never train models on your data.
Acceptance and relationship to the site terms
These beta terms (the "Beta Terms") govern access to and use of the dispatchr application available at dispatchr.dev, including its testing agents, dashboards, and related services (the "Service"). The Service is operated by Dispatchr Labs Inc., a corporation organized under the laws of the State of Delaware, USA (Delaware file number 10721314), with operations based in Dublin, Ireland ("Dispatchr", "we", "us", or "our"). Our registered address is c/o Legalinc Corporate Services Inc., 131 Continental Dr, Suite 305, Newark, DE 19713, USA.
By accepting a beta invitation, creating or using an account, or otherwise using the Service, you accept and agree to be bound by these Beta Terms. If you use the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and "you" and "Customer" refer to both you and that entity. If you do not agree to these Beta Terms, do not use the Service.
The marketing website at godispatchr.ai is governed by its own terms of use (/legal/terms). Our privacy policy (/legal/privacy) describes how we handle personal data for both the website and the Service. If these Beta Terms conflict with the site terms of use with respect to the Service, these Beta Terms prevail.
The beta program
The Service is an invite-only closed beta. We approach design partners directly; there is no self-serve signup and no waitlist. Access is granted at our discretion and may be revoked at our discretion.
The Service is free of charge during the beta. Paid plans will come later under their own terms; we will never move you onto a paid plan without a separate agreement you have expressly accepted. Nothing in these Beta Terms obligates us to launch the Service generally, to keep any feature, or to offer you access to any future version.
Eligibility and your account
The Service is open to businesses and to individuals. You must be at least 16 years old to use the Service; no one under 16 is permitted on the platform.
You agree to provide accurate account information and keep it current, to keep your login credentials confidential, and to notify us promptly at legal@godispatchr.ai if you suspect unauthorized use of your account. You are responsible for all activity that occurs under your account.
The Service
dispatchr deploys human-like AI testing agents that explore, exercise, and test the software you configure, and reports what they find as findings, logs, screenshots, and recordings.
The Service is beta software, provided as is. During the beta we make no service-level commitments, no uptime commitments, and no support commitments. Features may change, be paused, or be removed at any time while we build. Agents are probabilistic: they may miss defects, report false positives, or behave in unexpected ways. Test results are an input to your own engineering judgment, not a certification of quality, security, or fitness for release.
Your targets
You choose the systems our agents test (each a "Target"), and you decide whether a Target is a staging environment or production. Agents interact with Targets the way real users do: they can create, modify, and delete data and can trigger real actions in the tested software. You are responsible for understanding and containing that blast radius: choose appropriate environments, use test accounts and test data where you can, and prefer staging wherever production side effects would be unacceptable.
You represent and warrant that you own, or are expressly authorized to test, every Target you configure, including the authority to provide the credentials you supply for it. Configuring a system you are not authorized to test is a material breach of these Beta Terms.
You agree to indemnify us for claims arising from Targets you configured, as set out in section 15.
Immediate suspension
We may suspend test runs, agents, or accounts immediately and without prior notice where, in our reasonable judgment, continued operation risks harm to a Target, to a third party, or to our infrastructure, or breaches the authorization warranty in section 05.
Notice follows: after a suspension we will contact you promptly, explain what we observed, and work with you in good faith to restore access where that can be done safely.
Your data
In connection with the Service we process four categories of data for you (together, "Customer Data"):
- Account identity: your name, email address, and workspace details
- Targets and configurations: the test targets you set up, including credentials you provide for the systems our agents will test
- Test results: the findings, logs, screenshots, and recordings our agents capture from the tested software
- Usage telemetry: product usage data about how your workspace uses the Service
Target credentials are stored encrypted at rest and are used only to run the tests you configure.
You own all test results and reports. We take only the license we need to operate the Service for you: a non-exclusive license to host, process, transmit, and display Customer Data solely to provide and secure the Service.
We never train or fine-tune AI models on Customer Data. The AI models that power our agents are self-hosted on infrastructure we control; no external AI provider processes Customer Data.
Customer Data is hosted on Amazon Web Services (AWS) across multiple regions. Where processing occurs outside the European Economic Area, transfers are safeguarded by the European Commission's Standard Contractual Clauses. Product usage telemetry is processed by PostHog (PostHog Cloud EU, hosted in the European Union) as a subprocessor.
The application sets strictly necessary session and authentication cookies plus PostHog analytics; there is no advertising and no cross-site tracking anywhere. We send only service emails (security notices, changes to these Beta Terms, operational messages), never marketing email. If we confirm a personal-data breach affecting you, we will notify you without undue delay. The privacy policy (/legal/privacy) has the full details.
Confidentiality
Confidentiality is mutual. We keep Customer Data, your configurations, and your test results confidential, use them only to provide the Service for you, and disclose them only to subprocessors bound by confidentiality obligations or where required by law.
You agree to keep non-public information about the Service (features, roadmap, performance, and other product details we have not made public) confidential until we make it public or tell you otherwise in writing.
These obligations do not apply to information that is or becomes public through no fault of the receiving party, was lawfully known to the receiving party before disclosure, is independently developed without use of the other party's confidential information, or must be disclosed under law or court order (with prompt notice to the other party where legally permitted).
Personal data in test content
Test results can include personal data drawn from your systems: a screenshot of a user profile, a log line containing an email address, a recording of a session. During the beta, this content is protected under the confidentiality obligations in section 08 and handled as described in the privacy policy (/legal/privacy).
Minimize personal-data exposure in your Targets. Wherever possible, point agents at staging environments seeded with synthetic or anonymized data rather than production data about real people.
We will offer a Data Processing Agreement at general availability. No DPA is in place during the beta, and you should factor that into which Targets and which data you configure.
Feedback and publicity
You are not required to give feedback. If you do (ideas, suggestions, bug reports, feature requests), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that feedback for any purpose, without compensation or attribution. Feedback never includes Customer Data; your test results remain yours under section 07.
We will never name you as a customer or use your name or logo in marketing, sales materials, or anywhere else without your prior written consent.
Data export and deletion
If you ask within 30 days of closing your account, we will export your test results and reports to you in a reasonable format.
We delete Customer Data within 30 days of account closure or of your deletion request, except for specific records we are legally required to retain, which we delete once the legal requirement ends.
Changes to these terms
We may revise these Beta Terms as the Service evolves. Material changes are emailed to account holders and take effect 14 days after the email is sent. Your continued use of the Service after the effective date constitutes acceptance of the revised Beta Terms. If you do not agree to a change, stop using the Service and close your account before the change takes effect; the export and deletion commitments in section 11 apply.
Changes that are not material (clarifications and corrections that do not reduce your rights) take effect when posted on this page, and the date above always reflects the current revision.
Disclaimer of warranties
THE SERVICE IS A BETA. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE, THE AGENTS, AND ALL TEST RESULTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE AGENTS WILL FIND ANY OR ALL DEFECTS OR VULNERABILITIES IN A TARGET, THAT TEST RESULTS WILL BE COMPLETE OR CORRECT, THAT THE SERVICE WILL BE AVAILABLE, SECURE, OR UNINTERRUPTED, OR THAT AGENT ACTIVITY WILL BE FREE OF UNINTENDED SIDE EFFECTS ON A TARGET.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DISPATCHR LABS INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, FOUNDERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, THE AGENTS, ANY TEST RESULTS, OR THESE BETA TERMS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ALL OTHER LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE BETA TERMS IS EXCLUDED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
NOTHING IN THESE BETA TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE WHERE IT CANNOT BE LIMITED, OR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE.
Indemnification
You agree to indemnify, defend, and hold harmless Dispatchr Labs Inc. and its officers, directors, employees, founders, and agents from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or connected with:
- Targets you configured, including any claim that testing a Target was unauthorized or caused harm
- your breach of these Beta Terms, including the authorization warranty in section 05
- your violation of applicable law in connection with the Service
This obligation does not apply to the extent a claim results from our own breach of these Beta Terms, and it applies only to the extent permitted by the mandatory laws of your country of residence.
Term and termination
These Beta Terms apply from your first access to the Service until terminated. You may stop using the Service and close your account at any time. We may suspend or terminate your access at any time at our discretion, with or without cause; where practical we will give notice, and section 06 governs immediate suspension.
On termination or closure, your access to the Service ends and the export and deletion commitments in section 11 apply. Sections that by their nature should survive termination (including sections 07, 08, 09, 10, 13, 14, 15, 17, and 18) will survive.
Governing law and venue
These Beta Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Subject to the paragraph below, the state and federal courts located in the State of Delaware will have exclusive jurisdiction over any such dispute, and each party consents to personal jurisdiction and venue there. These Beta Terms contain no arbitration clause; disputes go to the courts.
If you are a consumer or a data subject in the European Union, the European Economic Area, the United Kingdom, or another jurisdiction whose laws grant you mandatory protections, nothing in this section deprives you of those protections, including your rights under the GDPR where it applies, or of your right to bring or defend proceedings in the courts of your country of residence where mandatory law gives you that right.
General provisions and contact
If any provision of these Beta Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of it, and no waiver is effective unless made in writing. These Beta Terms, together with the privacy policy (/legal/privacy), constitute the entire agreement between you and Dispatchr regarding the Service and supersede all prior understandings on that subject. You may not assign or transfer these Beta Terms or any rights under them without our prior written consent; we may assign these Beta Terms in connection with a merger, acquisition, reorganization, or sale of assets.
