These terms cover this website only: browse it freely, link to it freely, and leave the brand alone. The dispatchr application at dispatchr.dev runs under its own Beta terms.
Acceptance and eligibility
These terms of use (the "Terms") govern your access to and use of the website located at godispatchr.ai and its subpages (the "Site"). The Site is operated by Dispatchr Labs Inc., a corporation organized under the laws of the State of Delaware, USA (Delaware file number 10721314), with its registered address at Legalinc Corporate Services Inc., 131 Continental Dr, Suite 305, Newark, DE 19713, USA, and operations based in Dublin, Ireland ("Dispatchr", "we", "us", or "our").
By accessing or using the Site, you accept and agree to be bound by these Terms. If you do not agree to these Terms, do not use the Site. If you use the Site on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and "you" refers to both you and that entity.
You must be at least 16 years old to use the Site. No one under 16 is permitted to use the dispatchr platform, and by using the Site you represent that you meet this requirement and are old enough to form a binding contract under the laws of your place of residence.
The dispatchr application
The dispatchr application, available at dispatchr.dev, is a separate service currently offered as an invite-only closed beta. Access to and use of the application are governed by the Beta terms published at /legal/beta, not by these Terms. If these Terms and the Beta terms conflict with respect to the application, the Beta terms control.
Nothing on the Site grants access to the application. Beta invitations are extended by Dispatchr to selected design partners; the Site offers no self-serve signup and operates no waitlist.
The Site and its informational nature
The Site is an informational website presenting dispatchr, a software testing platform in development that deploys human-like AI testing agents. The Site offers no user accounts, no payment functionality, and no purchases. The contact form displayed on the Site is a user-interface demonstration and does not transmit or store anything you type into it; the channel that actually reaches us is email, as set out in section 14.
All content on the Site, including product descriptions, capabilities, feature lists, and timelines, describes work in progress and may be changed, suspended, or withdrawn at any time without notice. Nothing on the Site constitutes an offer capable of acceptance, a binding commitment to deliver any product or feature, a warranty of product capability or performance, or professional advice of any kind.
Intellectual property and limited license
The Site and everything on it, including the dispatchr name, the pixel-cursor marque, the wordmark, the site design, and all text, graphics, and other content (collectively, the "Materials"), are owned by Dispatchr Labs Inc. or its licensors and are protected by copyright, trademark, and other intellectual property laws. Except for the limited license below, no right, title, or interest in the Materials is transferred to you.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for informational purposes. Linking to the Site is welcome and requires no permission. Automated agents reading the Site's public pages are welcome; a machine-readable summary is published at /llms.txt.
Press carve-out: you may use the dispatchr logo, unmodified, in truthful press coverage of Dispatchr without asking us first. All other use of the dispatchr name, marque, wordmark, or other brand assets requires our prior written permission.
You may not, without our prior written permission:
- use the dispatchr name, marque, wordmark, or other brand assets outside the press carve-out above, or copy the Site's design
- scrape, harvest, or systematically extract Materials for republication, redistribution, or commercial exploitation
- present any of the Materials as your own or remove proprietary notices from them
Acceptable use
In connection with the Site, you agree not to:
- attempt to disrupt, overload, or breach the Site or the infrastructure on which it runs, including by denial-of-service attacks or the introduction of malicious code
- probe, scan, or test the Site for vulnerabilities, or attempt to gain unauthorized access to any system or network connected to it, without our prior written authorization
- misrepresent your affiliation with Dispatchr, or impersonate Dispatchr, its founders, or its personnel
- use the Site in violation of any applicable law or regulation, or to further any unlawful purpose
- circumvent, disable, or interfere with any security-related or access-control feature of the Site
Good-faith reading of public pages, whether by a person or by an automated agent, is not a violation of this section.
Third-party links
The Site may contain links to websites or resources operated by third parties. Those links are provided for convenience only. We do not control third-party websites, do not endorse their content, and accept no responsibility for them or for any loss arising from your use of them. Your use of a third-party website is governed by that website's own terms and policies.
Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND THE MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SITE WILL BE SECURE, FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY CONTENT, INCLUDING DESCRIPTIONS OF THE DISPATCHR PRODUCT, IS COMPLETE, CURRENT, OR RELIABLE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DISPATCHR LABS INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, FOUNDERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE OR THE MATERIALS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANY OTHER LIABILITY OF DISPATCHR LABS INC. ARISING OUT OF OR RELATING TO THE SITE, THE MATERIALS, OR THESE TERMS IS EXCLUDED TO THE FULLEST EXTENT PERMITTED.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE WHERE IT CANNOT BE LIMITED, OR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE.
Indemnification
You agree to indemnify, defend, and hold harmless Dispatchr Labs Inc. and its officers, directors, employees, founders, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or connected with your violation of these Terms, your violation of applicable law in connection with the Site, or your infringement of the rights of any third party. This obligation does not apply to the extent a claim results from our own breach of these Terms, and it applies only to the extent permitted by the mandatory laws of your country of residence.
Termination of access
We may suspend, restrict, or terminate your access to the Site, in whole or in part, at any time and without notice, including where we reasonably believe you have violated these Terms or where doing so is necessary to protect the Site, its infrastructure, or other visitors. We may also discontinue the Site, or any part of it, at any time. Sections of these Terms that by their nature should survive termination (including sections 04, 07, 08, 09, 11, and 12) will survive.
Governing law and venue
These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Subject to the paragraph below, the state and federal courts located in the State of Delaware will have exclusive jurisdiction over any such dispute, and each party consents to personal jurisdiction and venue there.
If you are a consumer or a data subject in the European Union, the European Economic Area, the United Kingdom, or another jurisdiction whose laws grant you mandatory protections, nothing in this section deprives you of those protections, including your rights under the GDPR where it applies, or of your right to bring or defend proceedings in the courts of your country of residence where mandatory law gives you that right.
Severability, waiver, entire agreement, assignment
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of it, and no waiver is effective unless made in writing.
These Terms, together with the privacy policy, the cookie statement, and the imprint published on the Site, constitute the entire agreement between you and Dispatchr regarding the Site and supersede all prior understandings on that subject. The Beta terms are a separate agreement governing the dispatchr application at dispatchr.dev. You may not assign or transfer these Terms or any rights under them without our prior written consent; we may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
Changes to these terms
We may revise these Terms from time to time as the Site and the dispatchr product evolve. The revised Terms take effect when posted on this page, and the "last updated" date above always reflects the current version. Your continued use of the Site after a revision takes effect constitutes acceptance of the revised Terms. If you do not agree to a revision, your remedy is to stop using the Site.
